1. Introduction

The Walter and Duncan Gordon Charitable Foundation (“The Gordon Foundation”) respects the privacy of our users. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Community Gallery service (the “Service”). The Terms of Use for using the Service can be found on the Terms of Use page.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last Modified” date at the bottom of the document. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Community website, (the “Site”), and you waive the right to receive specific notice of such changes or modifications.

You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Site and the Services after the date such revised Privacy Policy is posted.

This Privacy Policy applies to The Gordon Foundation, and any of its subsidiaries and affiliates (collectively, “we”, “us” or “our”). This Privacy Policy outlines the Personal Information (as defined below) that we may collect from you or that you may provide when you use the Service and submit or upload content using the Service. This Privacy Policy also describes our practices for collecting, using, sharing, maintaining, protecting and, disclosing that information.

  • Your community or organization name (optional).

We may also collect any additional Personal Information, including, but not limited to location, date of birth and any other information you may voluntarily provide us or make public while using the Services. We may also collect Personal Information from time to time through other communications with you including user support services and surveys.

You are under no obligation to provide us with Personal Information, however your refusal to do so may prevent you from using the Service and/or our mobile application. Once you review and accept the Terms of Use, we collect content you create and submit to us including photographs and written submissions through the use of our Services.

NON-PERSONAL INFORMATION

“Non-Personal Information” is information that does not identify you and is anonymous in nature. Aggregate information, such as demographic statistics of our users (i.e. average age or geographical location of our users), number of users of the Service, what pages users accessed or visited the most, and certain information volunteered by users, such as survey information, is also considered Non-Personal Information.

As you use the Services and the Site, we may automatically collect certain information including: (i) information about the type of device you are using or your individual device ID; (ii) your general use of the Site and the Services; (iii) details of your use, including traffic data, location data and other communication data that you access using the Site and the Services; or (iv) information about your device and internet connection, including your IP address, operating system, device and browser type. Any information we may collect automatically is statistical data only and would only be used to help improve the Site.

We may share Personal Information and Non-Personal Information about you for the purposes described in this Privacy Policy and the Terms of Use. We may share or disclose Non-Personal Information or aggregated information about users of the Site or Services without restriction.

We may share information about you with: (i) a subsidiary or an affiliate for purposes in accordance with this Privacy Policy; (ii) other users of the Service in relation to content you post or upload or submissions you send to us; (iii) service providers, contractors, suppliers, or partners we use to support the Service and who are bound by contractual obligations to keep any Personal Information confidential and use it only for the purposes for which it was disclosed to them; or (iv) to third parties to market their products or services to you if you have consented to or not opted out of these disclosures. We note that we would contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them.

You should take care when using the Services since the information you choose to make available can be seen by other users of the Service. We do not monitor the information you share, although we reserve the right to do so at our sole discretion. 5. Outside parties & websites

This Privacy Policy applies to our Site and our Services. We do not exercise control over the websites that may be displayed as links from within our Services. These other websites may place their own “cookies” or other files on your computer, collect data or solicit Personal Information from you. Your use of those websites and provision of Personal Information to such website shall be governed by the terms of use and privacy policy applicable to such third party websites.

6. Retention of information

We actively retain Personal Information only as long as it is required for our relationship to continue and a certain period of time afterwards to respond to queries or as required by federal and provincial laws. When this period ends, Personal Information is destroyed in accordance with applicable laws.

We use security measures to help protect your Personal Information. We use reasonable efforts to ensure that your Personal Information is stored and maintained in a secure environment. Upon your request to terminate your information, we will delete your submitted content from the Site and Services and your Personal Information will be removed from our active databases.

We reserve the right to modify or supplement this Privacy Policy at any time, acting in our sole discretion, which will be reflected by the “Last Modified” date at the bottom of the document. Any changes to this Privacy Policy will apply to information collected from the date of the posting of the modified Privacy Policy.
